Privacy policy

This policy explains how Tonic The Agency (“we”, “us”) handles personal information when you use tonic.com.au and related pages we operate (the “site”), including our contact forms. We are committed to protecting privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

How we collect personal information

We collect personal information directly from you (for example when you submit a contact form or contact us by email or phone) and automatically through your use of the site using technologies such as cookies, analytics tools, and security services.

What personal information we collect

Depending on how you use the site, we may collect or hold:

  • Contact and enquiry details when you submit our contact forms (including the popup contact form): your name, email address, topic or subject selection, and the content of your message.
  • Context related to your visit stored for the browser session so we can understand how enquiries relate to your journey on the site: for example, the referrer to the site, the first page you opened in that session, and the URL of the page from which you submitted the form.
  • Security and anti-abuse signals when you use the contact forms: we use Google reCAPTCHA v3 to help prevent spam and automated submissions. Google may process technical information (such as device and interaction data) in accordance with Google's Privacy Policy and Terms of Service.
  • Analytics and advertising data when you browse the site: we use Google Analytics 4 (GA4), implemented via Google Tag Manager, and Google Ads features to understand how the site is used and to measure and improve advertising performance. This may include information such as pages viewed, approximate location (at a regional level), device and browser characteristics, interactions with the site, and online identifiers (such as cookie IDs or similar technologies). This information is generally aggregated and not used by us to identify you directly.
  • Other information you choose to give us (for example in email or phone correspondence with us).

Why we collect and use this information

We collect, hold, use and disclose personal information to:

  • respond to enquiries submitted through the contact forms;
  • operate, secure and improve the site, including measuring performance and user experience;
  • measure and improve the effectiveness of our marketing and advertising (including via Google Ads integrations);
  • protect the site and our systems (including via reCAPTCHA and monitoring);
  • meet legal and regulatory obligations, and resolve disputes; and
  • otherwise carry out our ordinary business activities where the use is permitted under the APPs.

Disclosure of personal information

We may disclose personal information to service providers who assist us in operating the site and our business, including:

  • Google, including Google Tag Manager, Google Analytics 4, Google Ads features, reCAPTCHA, and where applicable Google Maps; and
  • providers that deliver hosting, email delivery, automation, analytics, or related technology for our website and enquiry workflows.

Some of these service providers may process personal information outside Australia, including in the United States and other countries where they operate infrastructure.

By using our site, you acknowledge that your personal information may be transferred to, and processed in, countries outside Australia. Where required, we take steps that are reasonable in the circumstances to ensure that overseas recipients handle personal information in a manner consistent with the Australian Privacy Principles.

We do not sell your personal information. We may disclose information if required or authorised by law (for example to law enforcement or regulators).

Storage and security

We hold personal information in our systems and those of our service providers. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure.

We retain personal information only for as long as necessary for the purposes described in this policy, unless a longer retention period is required or permitted by law.

No method of transmission over the internet is completely secure; we encourage you to use discretion when sending sensitive information.

Cookies and similar technologies

The site uses cookies and similar technologies for analytics, advertising measurement, security, and core functionality.

These may include:

  • analytics cookies (such as those used by GA4 via Google Tag Manager);
  • advertising and measurement cookies (including those associated with Google Ads features);
  • security-related technologies (such as reCAPTCHA); and
  • functional/session storage used to support contact forms and site behaviour.

Third-party providers, including Google, may set and access cookies or similar technologies on your device. You can control cookies through your browser settings; disabling some cookies may affect how the site or forms behave.

For more information about how Google handles data, see Google's Privacy Policy.
